Judicial Review of GMC - doctor's right to silence

Mr Justice Julian Knowles sitting in the High Court of Justice gave permission to a doctor for the Administrative Court to judicially review the determination of a Medical Practitioners Tribunal to allow itself to draw an inference from a doctor’s decision not to give evidence.


Mary O'Rourke QC and Sunil Abeyewickreme of gunnercooke llp represented the doctor before the High Court to request permission for judicial review.


Mr Justice Knowles ordered that a Divisional Court composed of a Lord Justice of Appeal sitting with a High Court Judge considered this important case.
